Terms of Use - The Celebrant Suite (Web Edition)
1. Introduction
These Terms of Use (“Terms”) govern your access to and use of The Celebrant Suite (“the Service”), owned and operated by Karen Hoare trading as Byronware (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.
2. Eligibility
You must be a registered Marriage Celebrant in Australia and at least 18 years of age. You warrant that all information you provide is accurate and kept up to date.
3. Licence to Use the Service
We grant you a personal, non‑exclusive, non‑transferable annual licence to access and use the Service for your professional celebrancy work. You must not share your login credentials, allow others to access your account, or copy, modify, reverse‑engineer, or commercially exploit the Service.
4. User Responsibilities
You are responsible for maintaining the confidentiality of your login details, ensuring the accuracy of information you enter, and complying with all legal obligations relating to marriage documentation. You must not use the Service for unlawful, harmful, or unauthorised purposes.
5. Data Ownership
You retain ownership of all client data you enter. By using the Service, you grant us permission to store, process, and back up that data solely for the purpose of providing the Service.
6. Administrative Access
We may access your account only when necessary, including technical troubleshooting, server errors, data corruption, security investigations, or accidental deletion or mismanagement of data. Access is restricted to authorised personnel.
7. Availability and Updates
We aim to provide continuous access but do not guarantee uninterrupted service. We may update, modify, or improve the Service at any time.
8. Fees and Billing
Annual licence fees are payable as published. Failure to pay may result in suspension or termination of access.
9. Termination
We may terminate your access if you breach these Terms, misuse the Service, or fail to pay your licence fees. You may terminate your account at any time. Upon termination, you will have limited “Read Only” access to your existing data.
10. Limitation of Liability
To the extent permitted by law, we exclude all implied warranties. Our liability is limited to the amount paid by you in the previous 12 months. We are not liable for indirect or consequential loss, including data loss.
11. Privacy
Your use of the Service is also governed by our Privacy Policy and the Privacy Act 1988 (Cth), overseen by the Office of the Australian Information Commissioner (OAIC).
12. Governing Law
These Terms are governed by the laws of Australia, including the Privacy Act 1988 (Cth) and the oversight of the Office of the Australian Information Commissioner (OAIC).
